Video History Today and Licensing.



The aim of Video History Today is to allow the subscribers and end users to be able to use downloaded images in any educational project they wish. 

        Encryption

With this in mind, none of the files have been encrypted (protected by a security-type programme) to prevent copying or monitor where the file is being used.  Encryption would prevent the user being able to easily cut and paste any clip or photo in the library to add to their project.

       So no limits?

Yes there are limits.


All the clips and images on the site (except where noted) are the copyright of Video History Today and can only be used according to the terms and conditions of the release; it is a criminal offence to share copyrighted material with another person.

In other words, the subscriber or member may make back up copies, move it to different devices (eg. portable pen drive) etc (otherwise called 'fair uses') but cannot repackage or rebrand the original downloaded files and pass to another person.  Similarly they cannot share the material with, for example, another school/college as every user requires their own subsciption. 

Similarly no user may sell either the original material from Video History Today or the work they have produced using original downloaded material from Video History Today.


        So what can a subsciber use the material for?

Video History Today is aimed at schools, colleges and universities.  Any material downloaded by the member can be cut/pasted/edited to make any sort of visual display/report which is used towards a school project or to demonstrate something within the school.  A subsciber may not pass on Video History Today material in any form (original or edited).


       Fair usage

Video History Today operates a fair usage policy.  The terms & conditions refer to 'misuse of the password', which means in practise that Video History Today will monitor how a subsciber uses their password, (eg using the password at two different locations at the same time).

To quote from the terms & conditions:

'If the Siteowner has reasonable grounds for believing that the User has misused or is misusing the Password, the Siteowner may require the User to change the Password or may suspend the User’s use of the access to the Site, including Paid-for Content, until such time as the Siteowner is satisfied that the security of the Site is no longer compromised by the User’s activities'.


       Summary

You are not purchasing the rights to the image (image means video and/or photograph), only the right to use. Video History Today still retains all copyright to the image and as such is protected by copyright law.

You are permitted to use the image for any of the following;

  • Making educational videos to be used within the subscriber's school (or other educational establishment).
  • As part of a school website or in order to promote the school with clear credit made to Video History Today.
  • For editorial or journalistic purposes when linked to a school paper or similar publication.

You are not permitted to use the image for any of the following;

  • Redistribution, resale, sub-licensing or re-licensing of image on website or other electronic media such as CD, DVD, Memory Device, etc other than for display purposes.
  • Image may not be used, either unmodified or modified, in any manner which may be deemed fraudulent, defamatory, racist, pornographic, obscene or in any way contrary to  the laws of the country or countries where the image is to be displayed.
  • Any usage which may cause potential hurt or damage to any individual, property or brand name displayed in the image.
